Namens Hans Spekman willen wij graag het verzoek doen aan de commissie
om de regering te vragen zo snel mogelijk op onderstaande brief van
Amnesty te reageren. Lukt dat niet meteen, dan willen we dat verzoek in
de volgende procedurevergadering Justitie aan de orde stellen.

Geachte leden van de vaste commissies voor Justitie en Buitenlandse
Zaken,

Morgenochtend vindt er wederom een groepsuitzetting plaats van
uitgeprocedeerde asielzoekers naar Bagdad. Amnesty International vraagt
de nederlandse regering en andere Europese regeringen met klem om
uitzettingen naar Irak op te schorten in verband met de
veiligheidssituatie. Ter informatie stuur ik u onderstaand
actie-document van Amnesty International.

asylum-seekers 

DETAILS OF SITUATION: 

Reliable civil society sources have informed Amnesty International that
authorities in the Netherlands and Sweden have organized a joint charter
flight to forcibly return Iraqi rejected asylum-seekers to Baghdad, Iraq
on 22 September 2010. Lawyers for a 29-year old rejected Iraqi
asylum-seeker from Baghdad referred to as “Mr E”, have confirmed
that he has been informed that he will be expelled from the Netherlands
on 22 September. Amnesty International believes that other Iraqi
rejected asylum-seekers in Sweden and the Netherlands are facing forced
return also on that date. 

Amnesty International believes that it is not safe to forcibly return
anyone to Iraq in the current situation of ongoing insecurity and
instability. Amnesty International believes that Iraqis from the five
provinces of Iraq considered to be particularly dangerous—Ninewa
(Mosul), Kirkuk, Diyala, Salah al-Din and Baghdad—as well as Al Anbar,
where there is also a perilous security situation, should be granted
refugee status or a form of subsidiary protection, and that in the case
of asylum-seekers from other provinces of Iraq an individual assessment
should be made to assess whether they also qualify for refugee status or
subsidiary protection. Any such assessment for protection should also
consider the viability and safety of the onward route of return for
those Iraqi rejected asylum-seekers from regions outside the Baghdad,
given the real risk en route from Baghdad to other regions, including
the Kurdistan region in the north of Iraq. In all cases where
asylum-seekers from Iraq are not eligible for refugee status or do not
qualify for subsidiary protection, Amnesty International believes host
countries should not remove them to the regions of Iraq considered to be
particularly dangerous, in violation of the principle of
non-refoulement. 

Various European states have continued to forcibly return rejected
asylum-seekers to Iraq despite guidelines issued by the UN refugee
agency (UNHCR) calling for no-one to be returned to the five provinces
considered especially dangerous. On 30 March 2010, the Netherlands
forcibly returned 35 Iraqis to Baghdad. Amnesty International has spoken
with several of the Iraqis forcibly returned on 30 March, some of whom
fear for their life and have been frequently changing their whereabouts
in Baghdad, and others who are not from Baghdad, but who are stranded
there as it is unsafe for them to travel to their home province. Most
recently, on 9 June 2010, a joint flight arranged by the authorities of
the Netherlands, Norway, Sweden and the UK forcibly returned
approximately 60 rejected Iraqi asylum seekers. On 16 June, the UK
forcibly returned over 50 rejected asylum-seekers to Iraq. On 1
September 61 Iraqis were returned to Iraq from the UK, the Netherlands,
Sweden and Norway. 

Iraqi rejected asylum-seekers forcibly returned from Europe on these
flights, and on previous flights, have alleged that they have been
ill-treated by European authorities during their removal, and that they
have been beaten and threatened by Iraqi security officials after
arriving at Baghdad airport. 

The Netherlands and Sweden are obliged under domestic and international
law, including the 1951 Refugee Convention, the Convention against
Torture and the European Convention on Human Rights, not to return
anyone to a country where they would be at risk of torture and other
serious human rights violations, including indiscriminate threats to
life, physical integrity or freedom arising from generalized violence.
Amnesty International has called for allegations of ill-treatment or
otherwise excessive use of force during removal be investigated
promptly, independently and thoroughly.   

        

ADDITIONAL INFORMATION 

The UN refugee agency (UNHCR) issued guidelines to states in April 2009
identifying Baghdad as one of five areas – along with the provinces of
Ninewa (Mosul), Kirkuk, Diyala and Salah al-Din – as particularly
dangerous and to which no Iraqis should be forcibly returned. UNHCR also
advised that no forcible returns should be conducted to other areas of
Iraq unless an individual assessment has been carried out which
indicates that it would be safe to return the individual in question.
The UNHCR has repeatedly reiterated its guidelines, including as
recently as 3 September 2010, in light of ongoing forced returns to Iraq
by European states.
